Ash Scattering – What to Know

Choosing a memorial or celebration of life allows for greater flexibility and creativity.

Texas law allows ashes to be scattered:

• On private property – with the owner’s written permission.
• Over uninhabited public land, rivers, lakes, or at sea – provided the scattering creates no public nuisance.
• In a cemetery’s dedicated scattering garden or designated area.

Practical tips:

• Remove ashes from any non-biodegradable container before scattering, as required by state law.
• Choose a calm day or use a scattering tube to prevent wind drift.
